After all, being the dissenting voice your team needs requires a bit mora strategy than a one-liner. So here are a few guidelines for playing devils advoc ate- without coming across as an evil mastermind.Know When to Play the PartIf Hollywood has taught us anything, its that you dont mess with the Prince of Darkness unless youre prepared to handle the consequences. Before you can play devils advocate in the office, you first need to seriously consider whether or not itll be worth it. There are some situations where no amount of help- nefarious or otherwise- will do anything but piss off your colleague. Playing the other side with your boss, for example, should be approached with extra care (and I dont recommended it for novice debaters).So before you engage the strategies below, first consider the worst-case scenario. How receptive is this colleague to feedback, based on past experience? Is she likely to go completely off the rails when she realizes youre poking holes in her idea? How might your challenge impact your working relationship with her or with your team? And what will your boss think when he or she hears about it? Try to im agine how the conversation could go wrong, and weigh that against the importance of the topic at hand.If you do decide to play devils advocate, then your next step isnt to say anything- its to to start listening.ListenBefore you can justify disagreeing with someones idea, let her fully lay it out for you first. That means Sit down, pay attention, and make sure the idea-sharer knows youre hearing her. Establishing that connection reinforces respect, and will make your colleagues much more receptive to feedback later on.As youre listening, try to find ways you actually agree, whether its in process or intent. Finding any common ground will help soften any feedback you give later on, and show that youve taken the time to consider the idea from every angle.Just think like your eighth-grade English Lit teacher told you, and tell yourself there are no dumb ideas. At least- not at first.Test in Real Life SituationsEven if youre positive an idea has no legs, the person sharing it obviously thought it did, so after youve heard all the nitty-gritty, ask how the plan would play out in real life.For example, if someone has an idea to increase productivity by corralling the team into a communal table in the middle of the office, ask how certain aspects of business would be impacted by the change. What happens if a client calls and the rest of the team is in the midst of a heated debate? What about confidentiality and privacy?By allowing your colleague to walk you through her vision of how various real situations would be handled, you not only confirm that shes considered those potential snags (or not) but you allow her the chance to discuss the challenges without coming right out and telling her you dont agree.Also, dont forget to keep an open mind during this stage. Playing the devils advocate to someone elses ideas also means you need to apply the same standards to your own. Give ideas an honest chance, and test out your own assumptions, too. Make it clear y ouve listened to the idea with an open mind, and shell be much more receptive to your point of view.Dont Beat a Dead HorseThat said, once youve made your point, dont dwell. If everyone has come to your way of thinking as a result, fantastic, but nobody appreciates a gloater. If, however, youve failed to sway everyone in the room, the same strategy applies. Give it a rest and let everyone marinate on the topic for a while before bringing it up again. Remember, if you havent convinced them yet, hearing your thoughts seven more times probably isnt going to do the trick. Youll need a much stronger argument- or to simply admit defeat. (Unfortunately, you cant win them all.)Whether you believe in a red-faced villain with horns and a tail or not, when it comes to playing devils advocate, the mayhem that could ensue if you dont play the part with care is as real as your paycheck, and it should be handled with that in mind. This law protects employees of a company as well as job applicants. All companies with 15 or more employees are required to adhere to the rules platzset forth by Title VII of the Civil Rights Act of 1964. The law also establish ed the Equal Employment Opportunity Commission (EEOC), a bipartisan commission that is made up of five members appointed by the president. It continues to enforce Title VII and other laws that protect us against employment discrimination. How Does Title VII of the Civil Rights Act of 1964 Protect You? Title VII of the Civil Rights Act of 1964 protects both employees and job applicants. Here are some ways in which it does that, according to the EEOC An employer cant make hiring decisions based on an applicants color, race, religion, sex or national origin. An employer cant discriminate based on these factors when recruiting job candidates, advertising for a job or testing applicants.An employer cant decide whether or not to promote a worker or fire one, based on the employees color, race, religion, sex or national origin. He or she cant use this information when classifying or assigning workers.An employer cant use an employees race, color, religion, sex or national origin to de termine his or her pay, fringe benefits, retirement plans or disability leave. An employer cant harass you because of your race, color, religion, sex or national origin. In 1978, the Pregnancy Discrimination Act amended Title VII of the Civil Rights Act of 1978 and made it illegal to discriminate against pregnant women in matters related to employment. Almost half a century after Title VII of the Civil Rights Act was passed, in 2013, the EEOC received93,727 individual complaints. Many claimed multiple types of discrimination. There were 33,068 complaints of race discrimination,27,687 claims of sex discrimination,3,721 reports of discrimination based on religion,3,146 claims of color discrimination and10,642 reports of national origin discrimination (Charge Statistics FY 1997 through FY 2013. Restricted Stock Unit Grants When an employer offers you shares of the company but places limitations on your ability to access or monetize the stock, it is said to be restricted. When a restricted stock award vests, you own the stock, and you can do whatever you want with it. Which Is Better? The answer to this question is, It depends. Generally, if the stock price is rising, stock options may be preferred. You can sell both at the higher market value, but with stock options, you have not had to commit to the purchase until the stock price reached the point at which you wished to sell. Alternatively, if the stock price stays the same or is trending downward, restricted stock may be better since you own the stock. Your un-exercised options have no value, and if the share price is below the strike price, they are effectively described as under-water. The stock, of course, has some value unless it declines to zero. Tax Considerations It is possible your restricted stock unit grant will trigger a tax liability upon the vesting date, regardless of whether you have s old the stock or not. Be sure to consult a qualified accountant or attorney for the latest rules on the tax implications of your particular award. (l) Radiographic evidence of retained foreign body or bone fragments secondary to the trauma and/or operative procedure in the brain.(m) Leptomeningeal cysts or Arteriovenous Fistula. History of moderate head injury (854.03) is disqualifying. After 2 years post-injury, applicants may be qualified if neurological consultation shows no residual dysfunction or complications. Moderate head injuries are defined as unconsciousness, amnesia, or disorientation of person, place, or time alone or in combination, of more than 1 and less than 24-hours duration post-injury, or linear skull fracture. History of mild head injury (854.02) is disqualifying. After 1 month post-injury, applicants may be qualified if aneurological evaluation shows no residual dysfunction or complications. Mild head injuries are defined as a period of unconsciousness, amnesia, or disorientation of person , place, or time, alone or in combination of 1 hour or less postinjury. History of persistent post-traumatic symptoms (310.2) that interfere with normal activities or have a duration of greater than 1 month is disqualifying. Such symptoms include, but are not limited to headache, vomiting, disorientation, spatial disequilibrium, impaired memory, poor mental concentration, shortened attention span, dizziness, or altered sleep patterns. Infectious Diseases of the Central Nervous System Current or history of acute infectious processes of the central nervous system, including, but not limited to meningitis (322), encephalitis (323), or brain abscess (324), are disqualifying if occurring within 1 year before ?anexamination, or if there are residual neurological defects. History of neurosyphilis (094) of any form, including but not limited to general paresis, tabes dorsalis or meningovascular syphilis, is disqualifying. Current or history or narcolepsy or cataplexy (347) is disqualify ing, Current or history of paralysis, weakness, lack of coordination, chronic pain, sensory disturbance or other specified paralytic syndromes (344) is disqualifying. Epilepsy (345) occurring beyond the 6th birthday, unless the applicant has been free of seizures for a period of 5 years while taking no medication for seizure control, and has a normal electroencephalogram (EEG) is disqualifying. All such applicants will have a current neurology consultation with current EEG results. Linus Yale, Jr Linus Yale, Jr Linus Yale, Jr. Linus Yale, Jr. (1821 1868) was born in Salisbury, NY, on April 4, 1821, to inventor Linus Yale, Sr., whose ancestors immigrated to the New World in colonial times from North Wales. The creator of sawmill head blocks and a millstone process, Linus Sr.s, real passion was locks, particularly those used in banks. From that interest and hours of tinkering came one of the first modern locks to use a pin-tumble mechanism, which could be traced back to the large wooden locks the ancient Egyptians built some 4,000 years ago. After receiving a patent for his design, Yale, Sr. went on to specialize in high-security bank locks, which he sold through the Yale Lock Shop he founded in Newport, NY, in 1847. While his son Linus would one day go on to follow in his fathers footsteps, the young Yale spent his early adulthood indulging his interest in painting, hoping one day to become a respected portraitist. He gave up that dream in 1850 when Linus, Sr. died, and decided to go into the family business, first tending his fathers lock shop then opening up his own in Shelburne Falls, MA. Linus Yale, Jr., invented a small cylinder lock with a pin tumbler mechanism and small flat key. Though artistic, Yale Jr. had a strong left-brained impulse to solve problems, and once he abandoned his dreams of being an artist, the mechanism by which traditional locks are opened became his major preoccupation. Troubled by the vulnerability of lock keyholes, which could be easily breached by pick- or explosive-wielding thieves, Yale invented an alternative design in 1851, which he called the Yale Infallible Bank Lock for safes and vaults. The enhanced security Yales lock provided was a combination that could be created by its owner and a keyhole that was embedded within the door behind a protective steel plate. For the next several years, Yale continued to focus on making the locks that opened by key safer, until he eventually found a way to do away with the key altogether, and the combination lock was born. Though Yales design picked up where his fathers pin and tumbler design left off, his scheme incorporated a smaller, flat key with serrated edges, that, when inserted, would move two internal sets of pins into the right position so that when the key was turned, the lock would open. Yale received patents for this design in 1865, ultimately arriving at his most important invention, the Yale cylinder lock, which would revolutionize the lock industry. He was responsible for a number of other lock innovations, including improvements to the clock lock, and he went on to receive the patent for the double combination lock. In October 1868, he threw his full weight behind cylinder locks, joining forces with Henry Robinson Towne, his partner in the Yale Lock Manufacturing Company, which they founded in Stamford, CT. Yale died on Christmas day just two months later. Though he would he would not live to see his company past its start-up, Linus Yale fulfilled an inventive vision that would propel the Yale Lock Manufacturing Company from one that employed just 35 people at its outset to a global concern with more than 12,000 employees.
